A design right protects the appearance of a product — such as its shape, lines, colours, or contours. This protection helps prevent others from copying or misusing your design.
To qualify for valid design protection, a design must:
- Be new; and
- Have an individual character compared to existing designs.
Registration is available for the Benelux, the European Union, or internationally, depending on where protection is needed.
⚠️ Design validation
The validity of a design is not substantively examined during the formal registration process. It is only assessed if the design right is invoked in legal proceedings — for example, in a dispute over infringement.
